Lawyer for Real Estate Fraud and Platting LawsMy last post discussed the disasterous results of an illegal subdivision located in Caldwell County.  The failure of the developer to comply with platting laws or obtain County approval of the Century Oaks subdivision (combined with County inaction) resulted in many Buyers holding useless properties.

My research on the Caldwell situation led to my discovery of a Platting Information webpage hosted by Texas Attorney General Ken Paxton. The web page is an excellent resource and contains a great summary of platting laws and considerations. It also contains links to the considerations and abuses that led to the adoption of these laws.

The website articulates overlapping regulatory authority between the State, cities and counties, and identifies relevant statutes.

In my last post, I generally referred to illegal subdivision and platting abuses as a historical “border problem.” The AG’s page contains a link  to a page containing a Historical Sketch of Texas Laws Related to Colonias Remediation and Prevention. This is an excellent read.
